Appeal from a judgment entered in the United States District Court for the Western District of New York pursuant to Fed. R. Civ. P. 54(b), Richard J. Arcara, Judge, dismissing on statute-of-limitations grounds certain claims alleging personal injuries resulting from toxic substances transported to and maintained in a Cheektowaga, New York landfill. Cross-appeal seeking affirmance on the ground that the federal statute relied on by plaintiffs, altering the starting date of state-law limitations periods applicable to claims of injury caused by hazardous wastes, see 42 U.S.C. Â§ 9658, is unconstitutional under the Commerce Clause and the Tenth Amendment. See In re Pfohl Brothers Landfill Litigation, 26 F.Supp.2d 512 (1998), 68 F.Supp.2d 236 (1999).
